Client Terms of Service

These terms apply between EstateLeadAI Ltd ("EstateLeadAI", "we"), and the estate agency business that signs up to our service ("you"). The service is for business customers only.

1. The service

EstateLeadAI provides an AI receptionist that answers calls to your EstateLeadAI line, asks callers qualifying questions, drafts replies to written enquiries for you to review, and emails you a daily briefing. We set up the service using information you provide.

2. Fees and payment

• The fee is £499 per branch per month, billed monthly in advance.
• There is no setup fee.
• Calls are unlimited, subject to the acceptable use rules below.
• We may change prices with at least 30 days' written notice.

3. Term and cancellation

There is no minimum term. You can cancel at any time by email. The service continues until the end of the month you have paid for, and no further payments are taken. Fees already paid are not refunded for part months.

4. Your responsibilities

• You remain fully responsible for your agency services, including valuations, advice, negotiations, viewings and the handling of client money.
• You must review drafted replies before sending them and check the information in briefings before acting on it.
• You must give us accurate information about your agency and listings, and keep it up to date.
• You are the data controller for caller data and must have a lawful basis to process it.

5. Acceptable use

You must not use the service for unlawful, misleading or abusive purposes, for unsolicited marketing calls, or in any way that breaches telecoms or data protection law. We may suspend the service if you do.

6. Data protection

We process caller data as your processor under our data processing agreement, which forms part of these terms.

7. Liability

The service uses AI and may sometimes make mistakes or miss information. We do not exclude liability for death or personal injury caused by negligence, fraud, or anything else that cannot be excluded by law. Otherwise, we are not liable for loss of profits, sales, business or opportunity, or any indirect loss, and our total liability in any 12-month period is limited to the fees you paid us in that period.

8. Changes to these terms

We may update these terms with at least 30 days' notice. If you do not agree, you may cancel before the change takes effect.

9. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
